BNP Paribas, помимо передачи документов (включая РОР) по системе bank-to-bank, ещё подтверждает наличие ресурса у своего клиента.
Как оно делает и зачем?
Как?
В сущности это очень просто.
Банк, имея на руках РОР, принесенный клиентом, запрашивает соответствующие организации.
Как правило Банку достаточно номеров договоров, чтобы сделать такой запрос.
Например.
Клиент показывает договор с АК «Транснефть» (или АК «Транснефтепродукт»). Банк запрашивает на предмет наличия данного договора (не липа ли этот договор) и все ли требования выполнены Клиентом. Т.е. осуществлена ли предоплата Клиентом за прокачку и т.д.
После того как Банк получит письменные подтверждения он смело дает подтверждение контрагенту по сделке своего клиента.
Конечно всё легко и просто на словах и достаточно сложно в реальность. Но тем не менее это существует. 
Теперь вопрсо ЗАЧЕМ это нужно банку?
1) Дополнительный и неплохой доход для Банка. Ведь за такую гарантию Банк запросит хорошую комиссию!
2) Оберегая интересы своих клиентов. Как?
Выше я говорил, что под РОР западные банки выдают кредиты. Так вот контрагент Вашего Клиента может получить кредит, но не проплатить товар, согласно РОР, а использовать его по иному назначению.
В этом случае Банк может и направлять РОР в банк контрагента своего Клиента, а выдать лишь подтверждение того, что РОР проверен и Банк гарантирует его реальность.
И это тоже стОит денег!

Все трейдеры, осуществляющие поставки на условиях FOB, рано или поздно сталкиваются с проблематикой взаимосвязи пунктов торговых контрактов и чартеров, касающихся исчисления сталийного времени и расчета демереджа. Одни и те же положения, регулирующие laytime/demurrage, могут быть по-разному сформулированы в чартерах и торговых контрактах и не обязательно быть «зеркальными». Несогласованность договорных положений в этом вопросе может привести к разногласиям между продавцом и покупателем в определении размера демереджа.
Pre-advice в контрактах FOB
Стандартные торговые контракты, такие как GAFTA 49, содержат положение: « Не менее чем за «….» последовательных дней покупатели должны подать уведомление, содержащее название судна и ожидаемую дату его готовности, а также предполагаемый размер тоннажа к погрузке ». Такой промежуток времени именуется pre-advice period.
На практике нередко бывает так, что продавец имеет возможность организовать погрузку практически сразу же после получения им pre-advice или нотиса о готовности. В таких случаях на первый план выходит вопрос: если судно принято продавцами под обработку до истечения периода pre-advice, начинается ли сталийное время после подачи нотиса о готовности или же только по окончании pre-advice period?
В целом, оговорки о сроках в торговых контрактах могут расцениваться как условия, дающие сторонам возможность быть уверенными, что в случае срыва или задержки исполнения контракта они смогут примерно в те же сроки заключить заменяющую сделку или предпринять иные действия для уменьшения убытков. Такие оговорки привносят ясность в вопросы сроков и, таким образом, защищают обе стороны.
Некоторые типовые контракты (такие как FOSFA 53) уже в стандартном тексте содержат условие, устраняющее неоднозначность: « Сталийное время не начинается до истечения минимального количества дней pre-advice о номинации судна, если только продавец не согласится начать погрузку ранее, и в этом случае сталия начинается, когда судно фактически начало погрузку ». В торговле зерновыми стороны обычно самостоятельно составляют и вносят в контракты положения о том, что сталийное время не начинает течение до окончания pre-advice period, а также что нотис о готовности не является валидным до вышеуказанного момента. Конструкция этих оговорок зачастую допускает многозначное толкование.
Коммерческий смысл пункта о pre-advice period заключается в том, чтобы дать продавцу разумное время для принятия необходимых мер и приготовлений к погрузке. Важный вывод можно сделать из решения по делу Thai Maparn Trading Co Ltd v. Louis Dreyfus Commodities Asia Pte Ltd[2011]: pre-advice может рассматриваться как дополнительное средство защиты продавцов от риска расходов, связанных с «неожиданным» приходом судна под погрузку. В данном прецеденте было установлено, что обязательство продавца по погрузке, а также отсчет сталийного времени не могут начинаться с момента подачи нотиса о готовности, если он был подан до истечения pre-advice period. Однако вышеизложенное отнюдь не освобождает продавца от обязанности иметь товар готовым к погрузке в течение всего периода поставки.
Изменения после подачи pre-advice?
Ситуация может усложниться, если в течение pre-advice periodизменятся какие-либо существенные условия. Должно ли это время быть продлено, если покупатели номинируют иное судно? Должно ли оно продляться, если стороны пересогласуют количество груза?
Что касается судна-субститута, данная проблема была рассмотрена в деле Ramburs Inc v. Agrifert SA [2015] и освещена в статье «Номинация судна: где заканчивается право Продавца и начинается право Покупателя?», опубликованной на сайте АПК-Информ в декабре 2016 года. Что же касается изменения количества груза, то в одном из недавних дел Interlegal продавцы номинировали судно большей вместимости, чем это требовалось. Стороны в течение первого дня pre-advice period изменили существенные условия, связанные с номинацией судна, а именно: согласовали 25% увеличение количества товара, подлежащего погрузке. По нашему мнению, такой значительный пересмотр условий может технически привести к необходимости переноминировать судно, и, несмотря на то, что этого фактически не произошло, период pre-adviceдолжен считаться начавшимся заново с момента пересмотра условий.
Нотис о готовности: формулируем четко
Отдельно хотелось бы акцентировать внимание на следующем. Распространена практика, когда стороны включают в договор противоречащие друг другу пункты, относящиеся к подаче нотиса о готовности. В одном абзаце могут одновременно встретиться следующие фразы:
« Нотис о готовности должен быть подан с погрузочного причала, когда судно во всех отношениях готово к загрузке »
Такие формулировки совершенно точно создают ненужную двусмысленность и закладывают потенциальную «часовую бомбу». Первое положение дает продавцу возможность заявить, что нотис о готовности, поданный не от причала, является преждевременным и недействительным, со всеми вытекающими последствиями. И, наоборот, второе положение работает на покупателя и судовладельца, предоставляя им возможность подать нотис на лоцманской станции или рейде. Очевидно, что для спокойствия всех сторон и беспроблемного исполнения сделки желательно избегать подобных неоднозначных или взаимоисключающих пунктов договора.
